WHAT    The previously scheduled Richmond City Charter Review Commission subcommittee meeting to discuss city charter requirements related to the city budget process has been canceled. Previously scheduled for Friday, September 18, 2009, the meeting had been rescheduled to meet Wednesday, September 23, 2009.
                               
The subcommittee process was established by the Commission to assist members with their review of the Richmond City Charter. Consisting of three Commission members each, the members of this subcommittee include:
                               
•    Dr. Robert Holsworth, Subcommittee Chairman
•    Mr. Orran L. Brown, Esq.
•    Dr. John Moeser

        The ongoing review of the Richmond City Charter, which began in 2008, has been an open public process. The Richmond City Charter Review Commission has held numerous public meetings and has a website and email to help ensure that the entire process is open to the public.

WHAT    Councilman Charles R. Samuels, North Central 2nd District, and Councilman Chris A. Hilbert, Northside 3rd District, Richmond City Council, invite citizens to join them in celebrating the 100th Year Anniversary of the Ginter Park Residents Association.

“Neighborhood residents associations are great ways for families to come together, work together, and share time together in helping to make and keep our community clean, safe and beautiful,” says Councilman Samuels. “The Ginter Park Residents Association serves as an excellent example of the outstanding work being done by Richmond in helping to make our city an even better place to live, work, learn, play, visit, and raise a family.”

Established September 28, 1909, the Ginter Park Residents Association is a volunteer civic organization comprised of citizens living in Richmond’s historic Ginter Park Neighborhood, much of which was conceived in the late 1800’s by the wealthy industrialist, Major Lewis W. Ginter, and came in to being with the sale of the first home in 1898.

“Our neighborhood associations bring together thoughts, ideas and solutions that respond to the great many things that help to improve and increase the quality of life of all Richmond citizens,” says Councilman Hilbert. “The Ginter Park Residents Association is one of the great examples of how we, as citizens, show our love, care and commitment to our community.”

Located in parts of the North Central 2nd District and Northside 3rd District of Richmond, the Ginter Park Residents Association represents one of the nation’s first planned suburban neighborhoods, and is renowned for its cozy tree-lined streets, grand residences and architectural styles.

Among the oldest residents associations in Richmond and the United States, the Ginter Park Residents Association is also one of the most progressive; ensuring the right to vote to both male and female members more than a decade before the Nineteenth Amendment to the U.S. Constitution was ratified in 1920, which ensured women the right to vote in the United States.

The Ginter Park Residents Association is actively involved in historic preservation, neighborhood beautification and safety, and embracing the diversity of its estimated 2,500 residences.

Covering an area of only .54 square mile, the Ginter Park Residents Association is considered to be one of the most prosperous and influential neighborhood associations in Virginia, as its past and present residents include noted authors, artists, civic leaders and four state governors (Which includes: His Excellencies: John Garland Pollard, James H. Price, L. Douglas Wilder, and Tim Kaine).

On September 14, 2009, Richmond City Council honored the Ginter Park Residents Association during its Formal Meeting with an Award of Official Recognition. The award was sponsored by Councilman Chris Hilbert. Councilman Hilbert and his wife are 14-year residents of the Ginter Park neighborhood.

    Citizens are invited to join in the celebration of the Ginter Park Residents Association 100th Year Anniversary Celebration, which will follow the Association’s General Meeting.  The Celebration will honor the past, present and future of the organization.

BACKGROUND
The new Richmond Department of Public Utilities Stormwater Management Utility Program, recently approved by Richmond City Council, will target local flooding problems and include preventive maintenance, repair and improvements to the City’s storm drain system. With this program, entire storm drain systems in large areas of the City will be systematically cleaned before serious problems can occur.  Funding for the new Stormwater Management Utility Program will come from a fee, which will apply to all developed properties in Richmond, including homes, businesses, and non-profit organizations. The collected funds will be dedicated specifically for stormwater systems needs.

(Richmond, Virginia)  -- Councilman Charles R. Samuels, North Central 2nd District, Richmond City Council, releases the following statement regarding recent events this week in the vicinity of Maggie Walker Governor’s School, located in the North Central 2nd District.

“Recent events this week in the vicinity of Maggie Walker Governor’s School are of great concern to me. These events include: a suspicious package being found (empty tool box) in the school parking lot; a fire at a homeless encampment near School Street that the Richmond Department of Fire and Emergency Services extinguished promptly; and, the discovery of a body in a ravine in the 1000 block of Lombardy Avenue.

The body has been identified by the Richmond Police Department as Joseph C. McCray, 54, of no fixed address, and is being investigated as a homicide due to death by blunt force trauma.

Each of these events is sufficient to cause great concern for those who attend Maggie Walker Governor’s School and the neighbors in the Newtowne West Community.  Should the neighbors, families or community organizations wish to come together for solace and understanding of these events, I will support them in any way that I can.

I would like to extend my deepest sympathy to the family of Mr. McCray and ask that anyone with any information regarding this incomprehensible act to call Richmond Crime Stoppers, at 804.780.1000. 

I would also like to share with residents that there are a number of services for the homeless within the city that can assist those in need. Some of which include:

Operates free standing health care center in the area providing primary health care to the homeless, uninsured and underinsured regardless of their ability to pay.  Additionally, Daily Planet provides a 12-week job training and placement program to the unemployed homeless and offers at no charge to those in need:  eye care, dental care, mental health and psychiatric care, laundry and shower facilities, case management, mail and substance abuse services.

Richmond City Council encourages Richmond residents to sign up for a free one-on-one 30-minute foreclosure prevention meeting with a certified housing counselor

One day event - Reservations must be made in advance

WHAT    Richmond City Council encourages interested Richmond residents to sign up for a free one-on-one 30-minute foreclosure prevention meeting with a certified housing counselor. In this meeting, Richmond homeowners will be able to learn about available options in avoiding home foreclosures.

    This is a one day event opportunity and attendance is for Richmond residents by appointment only. Meetings will be held (in 30 minute slots during the hours of 9:00 a.m. – 5:00 p.m.) in four locations across Richmond, which coincide with some of the hardest hit areas for foreclosure in the city. Walk-ins will only be accepted if time slots have not been filled.

The Richmond City Charter Review Commission was established on July 28, 2008 by a Richmond City Council Resolution. The Commission will assist Richmond citizens with a comprehensive review of the Richmond City Charter in order to identify and correct potential conflicts and ambiguities in the present Charter following the City’s change from a Council-Manager to a Council-Mayor form of government in 2004.

Importance of Richmond City Charter ___________________________________________
Citizens of Richmond govern themselves at the state, local and federal level through a process known as Representative Democracy. In this form of government, people choose (elect) fellow citizens to act on their behalf in governing themselves. This self-governance includes deciding how tax monies are to be invested; what laws are needed; and, providing oversight on how government services are managed.
              
    In the United States of America and the Commonwealth of Virginia, the foundation of government is established in national and state constitutions. In Richmond, the city “constitution” is the Richmond City Charter. The Richmond City Charter contains the essential laws that define the structure, organization and powers of Richmond City government.  The Charter is established by and can only be changed by an official act of the Virginia General Assembly.

Uniqueness of Richmond's New Form of Government ____________________________
Richmond has the only Council-Mayor government of its type in Virginia and, due to the uniqueness and differences of State/local governments across the country, is the only one like it in the U.S. Some of the differences include, but are not limited to, the many differences in how local governments are established; national, state and local differences between the many powers and relationships of cities, counties and towns; and what is considered Virginia's strict use of the "Dillon Rule", which is essentially a legal principal that limits the powers granted to local governments to those expressly granted or implied by the state, or essential to a locality. The fact that the Dillon Rule principal is not uniformly applied nationally and/or is used differently by different States adds to the uniqueness of Richmond's form of government.

Richmond’s Change of Government Highlights __________________________________
•    The Richmond City Charter has undergone a number of changes since the last comprehensive review in 1947.
•    In November 2003, Richmond citizens voted by city referendum to essentially separate the legislative and administrative powers of Richmond Government and replace the Council-Manager form of government with a Council-Mayor form.
•    In support of this change, in 2004 the Virginia General Assembly passed House Bill 76, which changed the Charter of the City of Richmond, authorizing it to provide for the direct election of a mayor. Thus creating a Council-Mayor form of government.
•    The city now has three distinct government branches: Executive, Legislative and Judicial - which is similar to the state and federal “check and balance” government model.
•    January 2005 - New Council-Mayor Form of Government began.

Resolutions Creating Richmond City Charter Review Commission _________________
•    Richmond City Council Resolution # 2008-R114-115, establishing the Richmond City Charter Review Commission
•    Richmond City Council Resolution # 2008-R 136-137, amending the Richmond City Charter Review Commission in order to establish a deadline for the selection of a chairman by the Commission

Richmond City Charter Review Commission Process _____________________________
The members of the Richmond City Charter Review Commission will follow a process and timeline to review the Charter. This will include breaking the Richmond City Charter into sections or functional areas and establishing sub-committees to address those specific areas. These sub-committees will then bring recommendations back to the full Committee for review and discussion. The entire Charter review process will be open to the public and all citizens of Richmond are invited and welcome to attend any and all meetings and to provide written suggestions and/or recommendations.
              
    The work of the Commission is scheduled to take place from October 2008 through completion. A tentative deadline of October 1, 2009 has been chosen by the Commission for completion of their review.  The review process will include soliciting, collecting and reviewing recommendations from Richmond Citizens, city government staff and local elected officials, which will include Council members that have served since the change in government in 2005.
              
    Once completed, the findings of the Commission will be presented to Richmond City Council and the Mayor for their consideration.
              
    Once recommendations are considered, and if action is determined, a Council Resolution enumerating any specific changes will be prepared for Council approval. Once approved, a request would be made to the Richmond Delegation to the Virginia General Assembly (VGA) for changes to be made during the 2010 VGA Legislative Session.

Tasked with an historic undertaking, the Richmond City Charter Review Commission consists of nine members, who either live or work in Richmond; four of which appointed by Richmond City Council, four appointed by Mayor L. Douglas Wilder and a member selected by the original eight members of the Commission from outside the group to serve as chairman. WHAT            The Richmond City Council Commission on Architectural Review (CAR) Taskforce will hold a public hearing to receive public input concerning the process used by the Richmond City Council Commission on Architectural Review. The Taskforce was established by Richmond City Council Resolution 2009-R85-97 (attached) on July 13, 2009.

        The purpose of the Taskforce is to review the process and guidelines of the Richmond Commission of Architectural Review, which is tasked with providing oversight and review regarding the erection, reconstruction, alteration or restoration of buildings or structures within designated Richmond Historic Districts as to their architectural compatibility with existing historic landmarks, buildings or structures in that district.

Richmond has the only Council-Mayor government of its type in Virginia and, due to the uniqueness and differences of State/local governments across the country, is the only one like it in the U.S. Some of the differences include, but are not limited to, the many differences in how local governments are established; national, state and local differences between the many powers and relationships of cities, counties and towns; and what is considered Virginia's strict use of the "Dillon Rule", which is essentially a legal principal that limits the powers granted to local governments to those expressly granted or implied by the state, or essential to a locality. The fact that the Dillon Rule principal is not uniformly applied nationally and/or is used differently by different States adds to the uniqueness of Richmond's form of government.

Richmond’s Change of Government Highlights __________________________________
•    The Richmond City Charter has undergone a number of changes since the last comprehensive review in 1947.
•    In November 2003, Richmond citizens voted by city referendum to essentially separate the legislative and administrative powers of Richmond Government and replace the Council-Manager form of government with a Council-Mayor form.
•    In support of this change, in 2004 the Virginia General Assembly passed House Bill 76, which changed the Charter of the City of Richmond, authorizing it to provide for the direct election of a mayor. Thus creating a Council-Mayor form of government.
•    The city now has three distinct government branches: Executive, Legislative and Judicial - which is similar to the state and federal “check and balance” government model.
•    January 2005 - New Council-Mayor Form of Government began.

Richmond City Charter Review Commission Process _____________________________
The members of the Richmond City Charter Review Commission will follow a process and timeline to review the Charter. This will include breaking the Richmond City Charter into sections or functional areas and establishing sub-committees to address those specific areas. These sub-committees will then bring recommendations back to the full Committee for review and discussion. The entire Charter review process will be open to the public and all citizens of Richmond are invited and welcome to attend any and all meetings and to provide written suggestions and/or recommendations.
             
    The work of the Commission is scheduled to take place from October 2008 through completion. A tentative deadline of October 1, 2009 has been chosen by the Commission for completion of their review.  The review process will include soliciting, collecting and reviewing recommendations from Richmond Citizens, city government staff and local elected officials, which will include Council members that have served since the change in government in 2005.
             
    Once completed, the findings of the Commission will be presented to Richmond City Council and the Mayor for their consideration.
             
    Once recommendations are considered, and if action is determined, a Council Resolution enumerating any specific changes will be prepared for Council approval. Once approved, a request would be made to the Richmond Delegation to the Virginia General Assembly (VGA) for changes to be made during the 2010 VGA Legislative Session.

Douglas Wilder and a member selected by the original eight members of the Commission from outside the group to serve as chairman.
